Loyenta terms and conditions

1. The service

Loyenta, by BUILDEV S A S ("BUILDEV"), lets businesses offer their customers a digital stamp card with their own brand, on the web and in Google Wallet. It is used by businesses, directly or through the system they already use, and by platforms (partners) that integrate it through the API. By using Loyenta you accept these terms and the data policy.

2. Accounts and access

• Businesses sign in to the dashboard with their email and a one-time code. Protect access to your email: whoever controls it can sign in to your dashboard.
• Platforms create their keys in the developer portal. Keys are secret: use them only from your server, never in an app or a web page, and revoke them immediately if they leak.
• Test keys (loy_test_) are for testing only. Live keys (loy_live_) create real businesses, which receive real emails.

3. Plans and payments

Businesses: commercial terms are agreed with the platform through which the business uses Loyenta. If the platform suspends a business's service (for example, for non-payment), its program is paused: no stamps are awarded and the data is kept.

Platforms:

• Test mode (free): test keys have no cost and no expiry, but are only for integrating: up to 3 open test businesses, 10 customers per business, cards marked "TEST", and each test business closes after 15 days. Test cards must not be given to real customers.
• Live: requires a monthly or yearly subscription, paid in advance. BUILDEV products use an internal plan at no cost.
• Expiry: if the subscription expires, the account keeps working for a 5-day grace period. It is then paused: live keys stop working and its businesses' cards don't earn stamps. If payment isn't made within the following 30 days, the account is closed: its keys are revoked and its businesses' programs end. We send an email before each step.
• BUILDEV may change prices with advance notice; the change applies from the next period.

4. Business obligations

• Enroll only customers who accept the program terms and the processing of their data. Loyenta's sign-up page collects that consent and keeps the proof.
• Publish truthful program terms and deliver the rewards offered.
• Handle customers' requests about their data, with BUILDEV's help.
• Use on the card only brands and images it has the right to use.

5. Platform obligations

• Create businesses in Loyenta only with their owner's authorization and with truthful data.
• Tell their users that, when they turn on loyalty, their customers' data is sent to Loyenta.
• Respect the API limits and not try to access data of businesses that are not theirs. BUILDEV may revoke keys and suspend accounts in case of abuse.

6. Customer data (data processing)

For the data of each business's customers, the business is the controller and BUILDEV the processor (Decree 1377 of 2013, art. 25). BUILDEV agrees to:

• Process it only to provide the service and following the business's instructions.
• Keep it confidential and protected with reasonable security measures.
• Use only the providers listed in the data policy.
• Notify the business without undue delay of any security incident affecting its data.
• Help the business handle its customers' requests.
• When the service ends, let the business export its data and then delete it, except what the law requires to be kept.

7. Ownership

Customer data belongs to the business. The business keeps its brand and authorizes BUILDEV to use it only to display its card. Loyenta, its brand and its software belong to BUILDEV.

8. Google Wallet

Cards in Google Wallet depend on Google and its terms. BUILDEV does not control its availability; if it fails, the web card keeps working.

9. Availability and liability

BUILDEV makes reasonable efforts to keep Loyenta running without interruptions, but does not guarantee it will be error-free. To the extent permitted by law, BUILDEV is not liable for indirect damages or lost profits.

10. Suspension and termination

You can stop using Loyenta at any time. BUILDEV may suspend an account that breaches these terms, giving notice where possible.

11. Changes

If we change these terms substantially, we will publish them here and email registered businesses and platforms before they apply.
